Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of Pic N Video, the organized media platform for uploading, storing, organizing, and sharing property photography, cinematography, architectural plans, and documents (the “Service”). The Service is operated by Pic N Video (“Pic N Video”, “we”, “us”). By creating an account or continuing to use the Service, you confirm that you are contracting with Pic N Video and that you accept these Terms.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization.

Pic N Video provides a single library where members upload full-resolution photography, film, floor plans, and documents for residential and commercial properties, organize them automatically by property, share property folders with agents, photographers, videographers, and clients, download selected groupings, track the performance of promoted films, and commission production services. Memberships determine which capabilities are available to you.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information when establishing your account and to keep it current. You must be of legal age to form a binding contract.

You agree not to misuse the Service. Without limitation, you will not:

• Use the Service for any unlawful purpose, fraud, or spam;
• Infringe the intellectual property or privacy rights of others;
• Interfere with the security or operation of the Service, including introducing malware, probing, or scraping;
• Upload content you do not have the right to upload, or attempt to access another member’s property folders without authorization;
• Reverse engineer, resell, or redistribute the Service, or circumvent its technical limits.

You retain ownership of the photography, film, plans, documents, notes, and other materials you upload (“Content”). You grant Pic N Video a limited, non-exclusive license to host, store, process, and display your Content solely to provide and improve the Service, including generating thumbnails and enabling sharing with your collaborators. You are responsible for ensuring you have the rights to all Content you upload and for the accuracy of any information you add.

The Service, its software, documentation, branding, and design are the property of Pic Video. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with your membership for the duration of these Terms.

Membership capabilities are described on our pricing page. Payment, billing, tax, and refund mechanics for all orders are governed by Paddle’s Buyer Terms, available at paddle.com/legal/checkout-buyer-terms. Cancellation and refund terms are set out in our Refunds & Cancellation policy: you may cancel at any time, retain access through the end of the current billing period you have already paid for, and will not be billed again after that period ends. Upgrading your membership unlocks additional capabilities immediately; downgrading may restrict access to capabilities not included in the lower tier.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

The Service is provided on an “as is” basis. We do not guarantee that the Service will be uninterrupted or error-free, and we may modify, suspend, or discontinue features with reasonable notice.

We may suspend or terminate your access if you materially breach these Terms, fail to maintain an active membership where required, or present a security or fraud risk. You may close your account at any time. Upon termination, you may export your Content for a reasonable period before it is deleted.

To the fullest extent permitted by law, the Service is provided without warranties of any kind. Our aggregate liability for any claim arising from the Service is limited to the fees you paid us in the six months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill, except where liability cannot be excluded by law (such as fraud or personal injury).

You agree to indemnify Pic N Video for claims arising from your Content, your unlawful use of the Service, or your violation of these Terms.

These Terms are governed by the laws of the jurisdiction in which Pic N Video operates, without regard to conflict-of-laws principles, and any disputes will be resolved in the courts of that jurisdiction.

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
